George "B" Gilbert Single Copy Software License Agreement, Warranties And Limitation of Liability

Software License Agreement

George "B" Gilbert grants a license to use a registered copy of the software to the original purchaser of
the software (hereafter referred to as "purchaser"). The purchaser may use the activation code to
create a registered copy of the software on a single computer.

The purchaser may copy the activation code only for backup purposes. The purchaser may not modify
adapt, translate, rent sublease, assign, lease, loan, resell for proof, distribute, network or transfer the
activation code to another party under any circumstances or for any purpose whatsoever.

The purchaser may copy and distribute, without restriction or limit, an unregistered copy of the software.

Warranties

The sole warranty regarding the software is that the original download file is free from physical defects
in material and workmanship. If such defect occurs, the defective download file may be replaced without
cost or limit with another download file downloaded from any available source on the Internet. Should
such defect persist, the purchaser may send a check for US$5.00 to George "B" Gilbert to receive a set
of diskettes containing the installation files for an unregistered copy of the software.

The sole warranty regarding the activation code is that, when correctly entered by the purchaser, the
activation code will be accepted by the software and will, thereby, convert the software from an
unregistered copy to a registered copy. If the activation code fails to be accepted by the Software,
George "B" Gilbert will, at no cost, provide to the purchaser another activation code.

Limitation of Liability

Under no circumstances, and under no legal theory, tort, contract or otherwise, will George "B" Gilbert or
his licensors, be liable to the purchaser for any damages, including any lost profits, lost data, or other
indirect, special, incidental or consequential damages, arising out of the use or inability to use the
software, and data or information supplied, even if George "B" Gilbert, his licensors or authorized dealer
has been advised of the possibility of such damages, or for any claim by any other party. This limitation
of liability shall not apply to liability for death or personal injury to the extent applicable law prohibits such
limitation. Furthermore, some states do not allow the exclusion or limitation of incidental or consequential
damages so this limitation and exclusion may not apply to the purchaser.

The purchaser's sole and exclusive remedy for any breach of warranty is that George "B" Gilbert will
refund the purchaser. This software is provided "As-Is" and the purchaser accepts the entire risk as to
the quality and performance of the software. To the maximum extent permitted by applicable law, George
"B" Gilbert and his licensors disclaim all other warranties, express or implied, by statute or otherwise,
regarding the software, including the fitness for a particular purpose, quality, merchantability, or their
noninfringement. No oral or written information or advice given by George "B" Gilbert or his licensors,
their respective employees, distributors, dealers or agents shall increase the scope of the above
warranties or create any new warranties. The liability of George "B" Gilbert or his licensors under the
warranty set forth above is limited to the amount paid by the purchaser for the product. Some states do
not allow this exclusion of implied warranties, so the exclusion may not apply to the purchaser. In that
event, any implied warranties are limited in duration to 60 days from the date of the purchaser's
registration of the software.
